1. Scope i Purpose

 

1.1 This Policy explains the general post-expiration process that may apply to domini names managed through NiceNIC, including expiration, renewal, redemption, expired domini auction, pending delete status, i release of a domini name back to the public registration pool.

 

1.2 Domini lifecycle timing may vary depending on the top-level domini (“TLD”), registry rules, registry operato practices, applicable ICANN requirements, i other governing policies. Not all TLDs follow the same expiration, redemption, auction, o deletion process.

 

1.3 In the event of any inconsistency between this Policy i the applicable registry’s rules o miatoy ICANN policy, the applicable registry rules i miatoy policy requirements shall anteriorail.

2. Definitions

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stiard renewal fee, subject to the applicable TLD i registry rules.

 

2.3 “Redemption Grace Period” o “RGP” means the post-deletion recovery period, waquí available, during which an expired domini name may still be restoable fo an additional redemption fee plus the applicable renewal fee.

 

2.4 “Pending Delete” means the final pre-release stage, waquí applicable, during which the domini name can no longer be renewed, restoed, modified, o transferred.

 

2.5 “Eligible Domini” means a domini name that is subject to NiceNIC’s expired domini auction process. Not all TLDs o expired domini names are eligible fo auction.

 

2.6 “Caducad Domini Auction” means the expired-domini sale process that may apply to certain expired domini names befoe final deletion o release.

 

2.7 “Tancaout Auction” means the final sale phase fo certain Eligible Dominis that were not sold earlier in the expired domini auction process.

 

3. Effect of Expiration

3.1 Upon expiration, a domini name may stop resolving, i any website, email servei, o other servei associated with the domini name may cease functioning immediately o shotly taquíafter.

3.2 Segueixing expiration, NiceNIC may restrict changes to the domini name, including DNS changes, contact updates, transfers, o other account-level actions, in accodance with registry rules, security measures, operational requirements, o the expired-domini process then in effect.

3.3 Expiration does not mean that the domini name immediately becomes available to the public. Depending on the applicable TLD i registry rules, the domini name may pass through one o moe stages, including grace period, auction, redemption, pending delete, i eventual release.

 

4. Renovaral Notices i Customer Responsibility

4.1 NiceNIC may send renewal reminders i expiration-related notices befoe i after expiration, as required by applicable policy o as part of NiceNIC’s stiard operational process.

4.2 It is el teu sole responsibility to maintain accurate i current account i contact infomation, including el teu email address, i to monito the status of el teu domini names.

4.3 Failure to receive a renewal notice, reminder, invoice, o other communication shall not relieve you of responsibility fo renewing el teu domini name befoe expiration.

4.4 Si auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, i the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

 

5. Stiard Post-Expiration Renovaral

5.1 Fo many generic TLDs, an expired domini name may remain renewable fo approximately thirty (30) days after the Expiration Date at the stiard renewal fee. This is a general reference only i may vary by TLD.

5.2 Renovaral is not complete unless i until NiceNIC has successfully received i processed full payment of all applicable fees.

5.3 NiceNIC reserves the right to determine whether a domini name remains eligible fo stiard renewal, redemption, o other recovery based on the applicable TLD, registry status, auction status, i operational feasibility.

 

6. Caducad Domini Auction fo Eligible Dominis

 

6.1 Certain expired domini names may enter NiceNIC’s expired domini auction process befoe all recovery finestras have ended. This process applies only to Eligible Dominis i does not apply to all TLDs.

 

6.2 Fo Eligible Dominis under NiceNIC’s stiard expired-domini process, the following general timeline may apply:

 

Day 0 after expiration

The domini name expires. The registrant may generally renew the domini name at the stiard renewal fee during the initial post-expiration period, subject to applicable rules.

 

Day 26 after expiration

The domini name may enter expired domini auction. A this stage, the registrant may still be able to renew the domini name at the stiard renewal fee, unless otherwise restricted by the applicable process.

 

Day 31 after expiration

Si taquí is no active bid, the registrant may still be able to recover the domini name by paying the stiard renewal fee plus the applicable redemption fee.

Day 74 after expiration

The domini name may be removed from the registrant’s account i may no longer be renewable o restoable through NiceNIC. After that point, the domini name may become available fo re-registration only after the registry releases it.

 

6.3 Once an Eligible Domini has an active bid, pending comprar, completed sale, o other sale commitment under the expired-domini process, the registrant’s right to renew o restoe the domini name may be terminated o restricted.

 

6.4 NiceNIC does not guarantee that a domini name will remain recoverable until the end of any stated period if the domini is subject to auction, sale, registry restriction, o another applicable limitation.

 

7. Redemption Grace Period

 

7.1 Si an expired domini name is not renewed during the applicable grace period i if the applicable TLD suppots restoation after deletion, the domini name may enter the Redemption Grace Period.

 

7.2 During the Redemption Grace Period:

(a) the domini name may stop resolving;

(b) website i email serveis may remain unavailable;

(c) the domini name generally cannot be modified o transferred; i

(d) restoation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, i any taxes o miatoy fees.

 

7.3 Restoation during the Redemption Grace Period is not guaranteed i remains subject to registry suppot, operational feasibility, the domini’s current status, i the absence of auction o sale restrictions.

 

8. Pending Delete i Final Release

8.1 Si a domini name is not renewed o restoed during the applicable recovery periods, it may enter the Pending Delete stage, waquí suppoted by the applicable TLD.

8.2 During Pending Delete, the domini name cannot be renewed, restoed, transferred, o modified.

8.3 Fo many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the domini name to the public fo re-registration.

8.4 NiceNIC does not guarantee the exact time, date, o availability of a domini name once it is released by the registry, i NiceNIC does not guarantee that the fomer registrant will be able to re-registrar the domini name.

 

9. TLD-Specific Variations

 

9.1 Not all TLDs follow the stiard lifecycle described above. Certain ccTLDs i other TLDs may have shoter grace periods, no redemption period, no pending delete stage, o earlier renewal deadlines imposed by the registry.

 

9.2 The following TLD-specific rules may apply, subject at all times to registry changes i the controlling registry rules:

 

9.2.1 TLDs generally following the common lifecycle

Many ccTLDs generally follow a lifecycle similar to the stiard expiration, grace, redemption, i deletion process, including, fo example:

The following TLDs may need to be renewed twelve (12) days befoe the actual Expiration Date. Si not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befoe expiration:

.CH, .ES, .FR, .LI, .PE, .SG, .COM.SG, .COM.AU, .ORG.AU, i .NET.AU.

 

9.2.4 TLDs requiring action five (5) days befoe expiration

The following TLDs may need to be renewed manually o by auto-renewal no later than five (5) days befoe expiration i may otherwise enter a recovery o restricted state befoe the actual Expiration Date:

.CX, .DE, .EU, i .NL.

 

9.2.5 .CM dominis

.CM domini names generally do not enter a redemption period i may be sent fo deletion on the actual Expiration Date. They may become available fo public registration on the same day they expire, subject to registry release practices.

 

9.2.6 .GG dominis

.GG domini names may be reactivated from the customer account fo approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 i Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppot fo approximately twenty-six (26) additional days.

 

9.2.7 .PH, .COM.PH, .NET.PH, i .ORG.PH dominis

These dominis may not suppot a stiard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. Si the domini is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Suppot immediately.

 

9.2.8 .UK dominis, including second-level .UK dominis

.UK domini names, including .CO.UK, .ME.UK, i .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the domini name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. Si a .UK domini name has expired fo moe than thirty (30) days but has not yet been released i no longer appears in the account, the customer should contact NiceNIC Suppot promptly.

 

9.2.9 .TO dominis

.TO domini names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppot a stiard Redemption Grace Period. After that point, they may be reserved by the registry i may no longer be recoverable.

 

9.2.10 .NU dominis

.NU domini names may be reactivated in the odinary manner within approximately seven (7) days after expiration. Si not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restoation may still be possible through NiceNIC Suppot.

9.3 The TLD-specific infomation above is provided fo general reference only i may change at any time based on registry policy, registry system changes, o operational requirements. Customers should contact NiceNIC Suppot fo current TLD-specific recovery infomation.

 

10. Fees i Pagarments

10.1 Stiard renewal fees, redemption fees, restoation fees, auction-related fees, i any other applicable charges shall be those listed by NiceNIC at the time of processing o otherwise communicated by NiceNIC.

10.2 Redemption o restoation requires payment in full of all applicable fees befoe processing.

10.3 Tots fees paid fo expired-domini recovery, restoation, o special processing are non-refundable once processing has begun, except waquí otherwise required by applicable law.

 

11. No Guarantee of Recovery o Availability

11.1 NiceNIC does not guarantee that any expired domini name can be renewed, restoed, retained, transferred, o re-registrared after expiration.

11.2 NiceNIC does not guarantee:

(a) that a domini name will remain in a grace period fo any minimum time;

(b) that an expired domini name will not enter auction;

(c) that a domini name can be recovered after an active bid, pending comprar, o completed sale;

(d) that the registry will suppot restoation; o

(e) the exact date o time when a deleted domini name will be released to the public.

11.3 You ackaraledge that delayed action may result in additional fees, loss of recovery rights, interruption of servei, auction sale, o permanent loss of the domini name.

 

12. Limitation of Responsibility

12.1 Per the maximum extent permitted by applicable law, NiceNIC shall not be liable fo any loss of domini name, loss of use, interruption of website o email servei, business interruption, lost profits, loss of data, o other direct o indirect damages arising from:

(a) domini expiration;

(b) failure to renew on time;

(c) failure to receive notices;

(d) registry rules o registry actions;

(e) auction placement o sale;

(f) failed restoation; o

(g) release of the domini name to the public.

12.2 Nothing in this Policy limits any non-waivable rights that may apply under miatoy law.

 

13. Changes to This Policy

By applying to registrar a domini name, o by asking us to maintain o renew a domini name registration, you aquíby represent i warrant to us that (a) the statements that you made in el teu Registre Agreement are complete i accurate; (b) to el teu karaledge, the registration of the domini name will not infringe upon o otherwise violate the rights of any third party; (c) you are not registraring the domini name fo an unlawful purpose; i (d) you will not karaingly use the domini name in violation of any applicable laws o regulations. It is el teu responsibility to determine whether el teu domini name registration infringes o violates someone else's rights.

3. Cancel·larlations, Transfers, i Changes

We will cancel, transfer o otherwise make changes to domini name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written o appropriate electronic instructions from you o el teu authoized agent to take such action;

2. our receipt of an oder from a court o arbitral tribunal, in each case of competent jurisdiction, requiring such action; i/o

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party i which was conducted under this Policy o a later version of this Policy adopted by ICANN. (See Paragraph 4(i) i (k) below.)

4. We may also cancel, transfer o otherwise make changes to a domini name registration in accodance with the terms of el teu Registre Agreement o other legal requirements.

4. Miatoy Administrative Proceeding

This Paragraph sets foth the type of disputes fo which you are required to submit to a miatoy administrative proceeding. These proceedings will be conducted befoe one of the administrative-dispute-resolution servei providers listed aquí (each, a "Provider").

1. Applicable Disputes. You are required to submit to a miatoy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

1. el teu domini name is identical o confusingly similar to a trademark o servei mark in which the complainant has rights; i

2. you have no rights o legitimate interests in respect of the domini name; i

3. el teu domini name has been registrared i is being used in bad faith.

In the administrative proceeding, the complainant must prove that each of these three elements are present.

2. Evidence of Registre i Use in Dolent Faith. Fo the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration i use of a domini name in bad faith:

1. circumstances indicating that you have registrared o you have acquired the domini name primarily fo the purpose of selling, renting, o otherwise transferring the domini name registration to the complainant who is the owner of the trademark o servei mark o to a competito of that complainant, fo valuable consideration in excess of el teu documented out-of-pocket costs directly related to the domini name; o

2. you have registrared the domini name in oder to anteriorent the owner of the trademark o servei mark from reflecting the mark in a coresponding domini name, provided that you have engaged in a pattern of such conduct; o

3. you have registrared the domini name primarily fo the purpose of disrupting the business of a competito; o

4. by using the domini name, you have intentionally attempted to attract, fo commercial gain, Internet users to el teu web site o other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsoship, affiliation, o endosement of el teu web site o location o of a product o servei on el teu web site o location.

3. How to Demonstrate Your Rights to i Legitimate Interests in the Nom de domini in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how el teu response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate el teu rights o legitimate interests to the domini name fo purposes of Paragraph 4(a)(ii):

1. befoe any notice to you of the dispute, el teu use of, o demonstrable preparations to use, the domini name o a name coresponding to the domini name in connection with a bona fide offering of goods o serveis; o

2. you (as an individual, business, o other oganization) have been commonly karan by the domini name, even if you have acquired no trademark o servei mark rights; o

3. you are making a legitimate noncommercial o fair use of the domini name, without intent fo commercial gain to misleadingly divert consumers o to tarnish the trademark o servei mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding i Process i Appointment of Administrative Panel. The Rules of Procedure state the process fo initiating i conducting a proceeding i fo appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you i a complainant, either you o the complainant may petition to consolidate the disputes befoe a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befoe it any o all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy o a later version of this Policy adopted by ICANN.

7. Fees. Tots fees charged by a Provider in connection with any dispute befoe an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases waquí you elect to expi the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you i the complainant.

8. Nosaltres Involvement in Administrative Proceedings. We do not, i will not, participate in the administration o conduct of any proceeding befoe an Administrative Panel. In addition, we will not be liable as a result of any decisions rendered by the Administrative Panel.

9. Remedies. The remedies available to a complainant pursuant to any proceeding befoe an Administrative Panel shall be limited to requiring the cancellation of el teu domini name o the transfer of el teu domini name registration to the complainant.

10. Notification i Publication. The Provider shall notify us of any decision made by an Administrative Panel with respect to a domini name you have registrared with us. Tots decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact potions of its decision.

11. Availability of Court Proceedings. The miatoy administrative proceeding requirements set foth in Paragraph 4 shall not anteriorent either you o the complainant from submitting the dispute to a court of competent jurisdiction fo independent resolution befoe such miatoy administrative proceeding is commenced o after such proceeding is concluded. Si an Administrative Panel decides that el teu domini name registration should be canceled o transferred, we will wait ten (10) business days (as observed in the location of our principal office) after we are infomed by the applicable Provider of the Administrative Panel's decision befoe implementing that decision. We will then implement the decision unless we have received from you during that ten (10) business day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that you have commenced a lawsuit against the complainant in a jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In general, that jurisdiction is either the location of our principal office o of el teu address as shown in our Whois database. See Paragraphs 1 i 3(b)(xiii) of the Rules of Procedure fo details.) Si we receive such documentation within the ten (10) business day period, we will not implement the Administrative Panel's decision, i we will take no further action, until we receive (i) evidence satisfactoy to us of a resolution between the parties; (ii) evidence satisfactoy to us that el teu lawsuit has been dismissed o withdrawn; o (iii) a copy of an oder from such court dismissing el teu lawsuit o odering that you do not have the right to continue to use el teu domini name.

5. Tots other disputes i litigation

Tots other disputes between you i any party other than us regarding el teu domini name registration that are not brought pursuant to the miatoy administrative proceeding provisions of Paragraph 4 shall be resolved between you i such other party through any court, arbitration o other proceeding that may be available.

6. Nosaltres involvement in disputes

We will not participate in any way in any dispute between you i any party other than us regarding the registration i use of el teu domini name. You shall not name us as a party o otherwise include us in any such proceeding. In the event that we are named as a party in any such proceeding, we reserve the right to raise any i all defenses deemed appropriate, i to take any other action necessary to defend ourselves.

7. Maintaining status quo

We will not cancel, transfer, activate, deactivate, o otherwise change the status of any domini name registration under this Policy except as provided in Paragraph 3 above.

8. Transfers during a dispute

Transfers of a Nom de domini to a Nou Holder

You may not transfer el teu domini name registration to another holder (i) during a pending administrative proceeding brought pursuant to Paragraph 4 o fo a period of fifteen (15) business days (as observed in the location of our principal place of business) after such proceeding is concluded; o (ii) during a pending court proceeding o arbitration commenced regarding el teu domini name unless the party to whom the domini name registration is being transferred agrees, in writing, to be bound by the decision of the court o arbitrato. We reserve the right to cancel any transfer of a domini name registration to another holder that is made in violation of this subparagraph.

Changing Registradors

You may not transfer el teu domini name registration to another registrar during a pending administrative proceeding brought pursuant to Paragraph 4 o fo a period of fifteen (15) business days (as observed in the location of our principal place of business) after such proceeding is concluded. You may transfer administration of el teu domini name registration to another registrar during a pending court action o arbitration, provided that the domini name you have registrared with us shall continue to be subject to the proceedings commenced against you in accodance with the terms of this Policy. In the event that you transfer a domini name registration to us during the pendency of a court action o arbitration, such dispute shall remain subject to the domini name dispute policy of the registrar from which the domini name registration was transferred.

9. Policy modifications

We reserve the right to modify this Policy at any time with the permission of ICANN. We will post our revised Policy at this location at least thirty (30) calendar days befoe it becomes effective. Unless this Policy has already been invoked by the submission of a complaint to a Provider, in which event the version of the Policy in effect at the time it was invoked will apply to you until the dispute is over, all such changes will be binding upon you with respect to any domini name registration dispute, whether the dispute arose befoe, on o after the effective date of our change. In the event that you object to a change in this Policy, el teu sole remedy is to cancel el teu domini name registration with us, provided that you will not be entitled to a refund of any fees you paid to us. Requesters must confirm that they will hile any disclosed personal data lawfully i securely.
This includes maintaining appropriate technical i oganizational safeguards, limiting use of the data to the stated purpose, anteriorenting unauthoized disclosure, i complying with applicable privacy i data protection laws.
NiceNIC may request additional infomation if the requester’s data protection safeguards are unclear o insufficient.

4. Data Minimization
NiceNIC applies a data minimization approach.
This means NiceNIC may approve only part of a request, provide only the data elements necessary fo the stated purpose, o deny data elements that are excessive, unsuppoted, o outside the scope of registration data disclosure.

5. Case-by-Case Review
Each request is reviewed on its own merits.
NiceNIC may approve, partially approve, deny, o request additional infomation.
A prio decision does not guarantee the same result fo future requests.

How to Enviar a Request
Fo gTLD non-public registration data requests, NiceNIC requires requesters to submit their requests through ICANN’s Registre Data Request Service, also karan as RDRS, waquí applicable.
RDRS is a centralized ICANN system that allows eligible requesters, including law enfocement personnel, government officials, cybersecurity specialists, consumer protection advocates, intellectual property professionals, i other parties with a legitimate interest, to submit stiardized requests fo gTLD non-public registration data.
Befoe submitting a request through RDRS, requesters should first check whether the requested data is already publicly available through ICANN Lookup.
When submitting a request through RDRS, requesters must include:
The exact domini name
The requester’s identity i contact infomation

NiceNIC does not process odinary email requests as fomal gTLD non-public registration data disclosure requests waquí RDRS is available.
Ordinary emails requesting non-public gTLD registration data may be answered by directing the requester to submit the request through RDRS.
Requests that are incomplete, unclear, overly broad, unsuppoted, outside the scope of registration data, o not submitted through the required channel may be denied o returned without disclosure.

Law Enfocement i Government Requests
Law enfocement o government agency requests fo gTLD non-public registration data should be submitted through ICANN RDRS waquí applicable.
Direct emails from law enfocement, government, police, o similar agencies do not automatically authoize disclosure of non-public customer infomation.
NiceNIC will review such requests based on:

NiceNIC does not disclose non-public customer infomation solely because a request is sent from a government, police, o law enfocement email address.

ccTLD Requests
ICANN RDRS applies to gTLD non-public registration data only. It does not apply to ccTLD domini names.
Fo ccTLD-related requests, NiceNIC does not disclose non-public customer infomation through odinary email requests.
Requesters may be required to provide valid legal process, registry-authoized instruction, o a clearly stated applicable legal basis.
ccTLD requests may also be subject to the rules i policies of the relevant country-code registry.

Response Timeline
Fo properly submitted gTLD non-public registration data disclosure requests that meet NiceNIC’s required fomat i are submitted through the required channel, NiceNIC will ackaraledge receipt without undue delay i no later than two business days after receipt.
NiceNIC will respond without undue delay i no later than thirty calendar days after ackaraledgement, unless exceptional circumstances apply.

Disclosure Decision
Si NiceNIC determines that disclosure is appropriate, NiceNIC may provide limited registration data necessary fo the stated purpose.
Si NiceNIC determines that only part of the request is justified, NiceNIC may provide a partial disclosure.
Si NiceNIC determines that the request is not sufficiently suppoted, no non-public registration data will be provided.
NiceNIC may require additional verification, documentation, o agreement terms befoe any disclosure is made.

We reserve the right, in our sole i absolute discretion, to change o modify this Agreement, i any policies o agreements which are incopoated aquíin at any time. We may occasionally notify you of changes o modifications to this Agreement o the Services by email so it is very impotant that you keep el teu Account infomation current i up to date. We are not responsible i we assume no liability fo el teu failure to receive an email notification if such failure results from inaccurate o outdated Account infomation.

1. Generic Domini de nivell superior Nom Registre

NiceNIC.NET is an accredited registrar with the Internet Copoation fo Assigned Noms i Numbers ("ICANN") fo generic top level domini names ("gTLDs") such as .com, .net, .og, .info, .biz, .jobs, i moe i various sponsoed top-level domini names ("sTLDs"). NiceNIC.NET may also, at its sole discretion, accept registration applications in non-ASCII character languages such as Chinese, Koean, i moe ("Internationalized Noms de domini" o "IDNs"). ICANN oversees registrations i other aspects of gTLDs policies i operations of accredited registrars like NiceNIC.NET. You ackaraledge i agree that el teu rights to any domini names registrared o renewed through NiceNIC.NET are subject to the policies i regulations of ICANN, the related Registry (as defined below) i various laws. You agree to abide by the terms in this Agreement to registrar i renew domini names as well as all terms i conditions of ICANN governing the registration i renewal of such domini names including, but not limited to, dispute resolution policies such as the Unifom Nom de domini Dispute Resolution Policy ("UDRP") o the Unifom Rapid Suspension Policy ("URS") as well as all current i future policies of Registries (as defined below) related to those domini names including, but not limited to, their acceptable use policies, privacy policies, i WHOIS data policies.

Domini name registrations are not effective until the registry administrato ("Registry" i "Registries" shall be construed accodingly) puts them into effect. Fo a list of Registries i fo moe infomation on top level domini names ("TLDs"), see www.icann.org/tlds/. Domini name registrations are created i renewed fo specified terms, terms which end on the specified expiration date if not renewed. Fo domini names which are created as a new registration out of the available namespace, the term begins on the date the domini name registration is created by the applicable Registry. You agree that we are not liable o responsible in any way fo any erros, omissions, o any other actions by the Registry arising out of, o related to a request to registrar, renew, modify, transfer, o renew a domini name. The registration o renewal is only effective once the Registry creates the registration o accepts the renewal.

In addition to gTLDs, sTLDS, i IDNs, NiceNIC.NET also registrars country code top-level domini names ("ccTLDs"). Taquí are additional agreements that you must agree to should you desire to apply fo registration of a domini name in any ccTLD. Each ccTLD Registry creates i enfoces its own rules, regulations, policies i procedures governing various aspects of ccTLDs registrared in their respective namespace o zone, including, but not limited to, dispute resolution policies which may be different to those promulgated by ICANN i WHOIS data policies which may also vary from ICANN's WHOIS policies.

When you registrar a ccTLD with NiceNIC.NET o one of its subsidiaries o affiliates, you ackaraledge i agree to, i are bound by, the respective ccTLD Registry's rules, regulations, policies i procedures.

We may publish potions of each ccTLD Registry's policies on the Site, including infomation on requirements, renewal policies, redemption policies, i other infomation from time to time. We are not liable in any way whatsoever fo any erros, omissions, o mistakes published on the Site. ccTLD Registry policies change from time to time i it is el teu responsibility to verify the rules, regulations, policies i procedures of each ccTLD Registry.

3. Premium Registre de noms de domini

You ackaraledge that we provide premium domini name registration serveis ("Premium Dominis") on the Site under separate agreements with unrelated 3rd parties ("3rd Party Services"). We act as an intermediary fo the comprar of Premium Dominis i we are not responsible fo the perfomance, completeness, corectness, o failure of the 3rd Party Services. Afegiritionally, you agree to abide by the terms i conditions required by the 3rd parties fo the use of the 3rd Party Services when such terms are made available to you prio to el teu election to use such serveis, i when such terms are subsequently updated.

4. Pre-registration, Sunrise, i Lirush

In the event that we make pre-registration available fo a gTLDs, sTLDs, IDNs, o ccTLDs whether in sunrise, lirush, general pre-registration phases, o other pre-registration phrases, we do not guarantee the successful registration of a pre-registration application o el teu immediate access to the domini name if successfully secured. We may use 3rd Party Services fo pre-registrations. Pre-registration fees, setup fees, i application fees are strictly non-refundable regardless of success o outcome.

5. No Guarantee of Registre o Renovaral

No domini registration under this Agreement shall be deemed effective until we deliver the domini name application o renewal application to the appropriate Registry i the Registry accepts el teu application i creates el teu domini name registration o renewal. Enviarting el teu application to us, i our accepting of Fees fo el teu application, by itself does not constitute a successfully registrared application o renewal.

You ackaraledge that we are in no way responsible fo i can never guarantee, that the domini name you are applying fo is not being applied fo by another party o with another registrar, that taquí are no inaccuracies in the Registry's WHOIS o other databases, that the search availability results are corect, o that taquí are erros, omissions, o inaccuracies that occur during the registration o renewal process which affect the result of el teu registration o renewal application.

You further ackaraledge i agree that you are solely responsible fo ensuring that el teu registration o renewal has been properly processed. We may elect to accept o reject el teu application fo registration o renewal at any time fo any reason at our sole i absolute discretion, including, but not limited to, pricing erros, attempts to apply fo domini names that are prohibited, improper, unavailable, infringe on 3rd party intellectual property o other rights, are questionable o violate any other agreements o terms i conditions contained in this Agreement o other agreements with us. You also ackaraledge i agree that we are not liable o responsible in any way fo erros, omissions, acts, inaccuracies related to the Site, o actions by any 3rd parties including any gTLD, sTLD, IDN, o ccTLD Registry arising out of el teu application o potential application fo, i registration o renewal of, a particular domini name.

6. Your Obligations

You ackaraledge that we do not check, unless it is explicitly required to do so by a Registry, to see whether the domini names you select, o el teu use of the domini name, o other serveis provided by us o unrelated 3rd parties in relation to the domini name, infringes on the intellectual property o other legal rights of others, violates the rules, regulations, policies, o procedures of the respective Registry, o violates local, state, national o international laws. It is el teu sole responsibility to understi i accept the terms i policies of each Registry to ensure that el teu application fo registration o renewal, i subsequent use, of the domini name does not violate any of these terms.

You represent to us that:

(i) You are at least 18 anys of age i are legally capable of entering into this Agreement with us;

(ii) You will not violate this Agreement i will comply with all local, state, national i international laws;

(iii) You will not use the Site o the Services fo any unlawful purpose.

(iv) You will not represent el teuself as another person o entity, o submit infomation on behalf of another person o entity without their express prio written consent;

(v) You will not provide false, inaccurate, o incomplete infomation in el teu application fo the Services;

(vi) You will maintain complete i accurate infomation with us at all times in relation to the Services;

(vii) You will not violate 3rd party trade o servei marks, copyrights, patents o other intellectual property rights;

(viii) Your use of the Services does not i will not result in excess use of our resources o overloading of our DNS, server o netwok resources;

(ix) You will not use the Services as a source o destination of packet flooding, mail bombs, packet coruption, denial of servei, o other illegal o abusive cyber activities;

(x) You will not conduct server hacking o promote hacking, cracking, o other cyber crimes o activities;

(xi) You will not deploy software o scripts to run on our servers that cause overload of resources o threaten the stability of the netwok;

(xii) You will not disseminate o transmit SPAM email in violation of our SPAM policy;

(xiii) You will not disseminate illegal, hateful, harmful, violent, racially o ethnically intolerant, abusive, obscene, ponographic, defamatoy, harassing, malicious, protected material, o content that otherwise violates the intellectual property rights of others;

We may terminate o suspend the Services at any time, at its sole discretion i without limitation, if it finds that you have violated any terms of this Agreement o other agreements with us. You agree that if we terminate o suspend the Services provided to you under this Agreement, that we may then, at our option, make either ourselves o a third party the beneficiary of Services which are substantially similar to those which were anterioriously providing to you i that any reference in this Agreement to termination o suspension of the Services to you includes this option.

7. Nom de domini Registrant

When applying fo i registraring a domini name with us, you will be asked to designate a registrant fo the domini name ("Registrant"). The Registrant is granted all rights under this Agreement to act in respect to the domini name i any other serveis obtained from us in connection with the domini name, including, but not limited to, the authoity to terminate, delete, transfer, renew, o otherwise modify the domini name o related Services, o obtain additional serveis in relation to the domini name.

The Registrant is responsible fo providing its own full contact infomation i fo providing i updating accurate technical i administrative contact infomation under this Agreement. A Registrant that licenses the use of a domini name shall accept liability fo harm caused by wrongful use of the domini name, unless the Registrant discloses the current contact infomation provided by the licensee i the identity of the licensee (in accodance with applicable data protection law) within seven (7) days to a party providing Registrant reasonable evidence of actionable harm.

Si you, acting as the Account holder, are providing Registrant infomation on Registrant's behalf, you represent that you have obtained consent from the Registrant i notice has been given to them sufficient to enter the terms of this Agreement on their behalf. Failure to do so it a material breach of this Agreement.

8. Administrative Contacte

When applying fo i registraring a domini name with us, you will be asked to designate an administrative contact fo the domini name ("Administrative Contacte") to confer certain rights to under this Agreement, including, but not limited to, purchasing additional serveis, transferring the domini name to another registrar waquí allowable by the applicable Registry, i updating the domini name settings. The Administrative Contacte may be the same as the Registrant. The Registrant is responsible fo all actions, erros o omissions of the Administrative Contacte.

9. Trustee Services

We may, from time to time, offer administrative, registrant, agent, o local presence serveis to you ("Trustee Services") in connection with the Services under this Agreement. Trustee Services may grant certain rights, access, duties i responsibilities to the grantee ("Trustee") with respect to the domini name. Trustee Services may designate another party as Registrant o Administrative Contacte fo el teu domini name, however, you retain all rights to the domini name granted to you under this Agreement until the termination of this Agreement, expiration, cancellation, o deletion of the domini name o transfer to another registrar, including the right to terminate the Trustee Agreement at any time.

In rare cases, fo certain ccTLDs, the use of, i subscription to, our Trustee Services may be required in oder fo us to manage el teu domini name regardless of whether you are able to satisfy the Registry requirements (fo example, including, but not limited to: .CW, .COM.AR, .EE, .RS, .AL, .BG, .GE, .COM.BN, .IQ, .SK, .CL).

By odering Trustee Services, you agree to be bound by the terms of the Trustee Services Agreement, which are incopoated aquíin i made part of this Agreement by reference.

You may, at el teu complete i sole discretion, revoke such designation i Trustee Services without notice by submitting a request in writing to us through the suppot ticket system o other written method. In no case will you be entitled to a refund in full o pro-rata fo any part of the term of the Trustee Service not fulfilled.

10. Private Registre

We may, from time to time, make available private registration serveis ("Private Registre Services"). Private registration provides you with the option of registraring a domini name in TLDs that allow such registration, in the name of a 3rd party whose contact infomation will be displayed in the public WHOIS database instead of el teu contact infomation. By odering Private Registre Services, you agree to be bound by the terms of the WHOIS Privacy Agreement, which is incopoated aquíin i made part of this Agreement by reference.

You may, at el teu complete i sole discretion, revoke such Private Registre Services without notice by submitting a request in writing to us through the suppot ticket system o other written method. In no case, will you be entitled to a refund in full o pro-rata, fo any part of the term of the Private Registre Services not fulfilled.

11. IDNs, Accuracy i Functionality of non-Latin Characters

You ackaraledge i agree that we cannot guarantee the accuracy i functionality of non-ASCII character languages such as Chinese, Koean, i moe ("Internationalized Noms de domini" o "IDNs"). We cannot guarantee that IDNs will be accessible by internet users o that they will be translated properly by the internationalized domini name system into readable punycode. Further, we make available on the Site translation tools provided by 3rd parties such as Google i that these tools are treated as 3rd Party Services under el teu agreements with us. We will in no way be liable fo the use of 3rd Party Services used fo translation. We will also not be liable fo suspension, modification, o cancellation of el teu IDNs in oder to comply with current o future ICANN o the Internet Engineering Task Foce ("IETF") rules, regulations, o technical stiards that apply to IDN registrations o renewals.

12. Transfers

You are able to transfer domini names to o from us accoding to the terms i transfer policies of the respective Registry fo the TLD of the domini name you wish to transfer. Each Registry has its own unique transfer policy which we adaquí to. Fo all TLDs under ICANN sponsoship, you may find moe infomation on the transfer policy that we are required to follow fo all TLDs under ICANN sponsoship aquí: http://www.icann.org/en/resources/registrars/transfers

In oder to determine who the sponsoing registrar currently is fo el teu domini name, please visit: http://www.internic.net/whois.html

In oder to protect el teu domini names, we place a transfer lock on domini names in many TLDs automatically when they are registrared o renewed with us. In oder to transfer to another registrar, you must remove this transfer lock. You are able to do this from el teu account on the Site.

Si you comprard Trustee Services o Private Registre Services from us when registraring o renewing the domini name you would like to transfer out, we must cancel these serveis, i you are required to replace any of our infomation, documentation, o our Trustee's infomation i/o documentation in relation to these serveis with el teu own infomation, befoe the transfer out will be approved by us.

You ackaraledge that when cancelling these serveis, this action may qualify as an ownership change o other update to the domini name which may incur additional fees o require you to renew the domini name with us prio to transferring the domini name to another registrar. Taquí will be no refund fo partially fulfilled terms fo Trustee Services o Private Registre Services.

In no event, shall we be liable fo the failure of a transfer o loss of el teu domini name if the transfer is initiated close to the end of the registration term, the transfer is not approved by the Registrant o Administrative Contacte of the domini name, the fees fo the Service remain unpaid o are in dispute, o any other reason outlined by ICANN o the Registry's transfer policies.


In the event that a Transfer Contacte listed in the Whois has not confirmed their request to transfer with the Registrador of Recod i the Registrador of Recod has not explicitly denied the transfer request, the default action will be that the Registrador of Recod must allow the transfer to proceed.

Upon denying a transfer request fo any of the following reasons, the Registrador of Recod must provide the Registrared Nom Holder i the potential Gaining Registrador with the reason fo denial. The Registrador of Recod may deny a transfer request only in the following specific instances:

  • Evidence of fraud
  • UDRP action
  • Court oder by a court of competent jurisdiction
  • Reasonable dispute over the identity of the Registrared Nom Holder o Administrative Contacte
  • No payment fo anteriorious registration period (including credit card charge-backs) if the domini name is past its expiration date o fo anteriorious o current registration periods if the domini name has not yet expired. In all such cases, however, the domini name must be put into "Registrador Hold" status by the Registrador of Recod prio to the denial of transfer.
  • Express written objection to the transfer from the Transfer Contacte. (e.g. - email, fax, paper document o other processes by which the Transfer Contacte has expressly i voluntarily objected through opt-in means)
  • A domini name was already in “l(fā)ock status” provided that the Registrador provides a readily accessible i reasonable means fo the Registrared Nom Holder to remove the lock status.
  • A domini name is in the first 60 days of an initial registration period.
  • A domini name is within 60 days (o a lesser period to be determined) after being transferred (apart from being transferred back to the oiginal Registrador in cases waquí both Registradors so agree i/o waquí a decision in the dispute resolution process so directs).

13. Fees, Refunds, i Cancel·larlation Fees

Tots Services under this Agreement are provided on a pre-paid o advanced basis.

The fees imposed by us under this Agreement are subject to change at any time, without notice, at our sole discretion. Such change shall be posted to the Site, with o without notice, i are effective as of the date of publication.

Tots fees under this Agreement are non-refundable, in whole o in part, unless the application fo domini name registration o renewal is rejected due to the following reasons:

(a) the domini name is unavailable because it is already registrared to another party, prohibited by the Registry's policies, o prohibited due to the violation of terms found in this Agreement o the Master Service Agreement;

(b) the TLD in which the domini name belongs has been discontinued, restricted due to government regulations o is no longer offered by us.

Domini registration requests made in any pre-registration, Sunrise, o Lirush phase are non-refundable, o are subject to a cancellation fee, unless el teu request is upgraded to an earlier phase, unavailable because it is registrared by another party, requested in an earlier phase by another party o prohibited by the respective Registry's policies.

We reserve the right to charge a cancellation fee in the case that you submit a domini name registration o renewal application i disregard, ignoe, overlook, mistake, o attempt to otherwise circumvent, the requirements imposed by the Registry o by us which cause el teu application to be incomplete o rejected.

Afegiritionally, we reserve the right to charge processing fees fo modifications ("Modification Fees") to el teu domini name, including, but not limited to, DNS changes, contact infomation changes to WHOIS infomation, i web fowarding changes. Generally, Modification Fees are not charged in relation to gTLDs. Modification Fees are common in relation to many ccTLDs.

Atention: we don’t issue any refund on serveis paid by crypto payment methods.

14. Renovaral i Expiration of Services

You ackaraledge that, even though we may provide an auto-renewal servei fo el teu convenience, it is el teu sole responsibility to keep el teu own recods i to maintain el teu own reminders regarding when el teu Services are set to expire to ensure that el teu Renovaral Fees are paid fo the Services prio to the due date.

As a convenience to you, i not as a binding agreement, we may notify you via the primary email address provided in el teu Account, o from the control panel in el teu Account, when Fees fo renewal of the Services are due ("Renovaral Fees"). Renovaral Fees are available in el teu Account at any time prio to the due date of the Renovaral Fees. It is el teu responsibility to ensure that the Renovaral Fees are paid in advance of the due date to anteriorent an interruption in Services o additional fees to restoe the Services.

With respect to domini name registration serveis, we will send expiration reminder notices to the primary email address of the Account holder. However, such notices are a courtesy only i our failure to send such notices shall not create any responsibility, obligation, o liability fo us.

You ackaraledge that registry operatos may have non-unifom Renovaral Fee policies in place. As such, el teu Renovaral Fee may be higher o lower than el teu initial registration fee o may be different between domini names in the same TLD. When possible, we will present the renewal fee to you upon el teu initial registration. Si this is not possible, you may see what the Renovaral Fee is by logging into el teu Account any time after the initial domini name registration i starting with the renewal process.

Si you odered additional serveis, including, but not limited to, Trustee Services, Private Registre Services, o any other serveis from us in conjunction with a domini name under this Agreement, those serveis shall be renewed at the same time as el teu domini name.

Fo certain ccTLDs, the due date of el teu Renovaral Fees may be up to 60 days prio to the expiration date of the underlying domini name registration. Certain Registries require renewal up to 60 days in advance of the domini name expiration date. It is el teu responsibility to pay fo el teu Renovaral Fees in advance of the due date specified by us regardless of the domini name expiration date. Failure to pay el teu Renovaral Fees prio to the due date may result in additional fees to restoe the domini name, suspension, loss, cancellation, o deletion of the domini name accoding to the ccTLD registry's respective policy.

Afegiritionally, you ackaraledge that payment of certain ccTLDs exactly on the due date may also incur additional fees to restoe the domini name, suspension, loss, cancellation, o deletion of the domini name.

We are not liable fo el teu failure to pay the Renovaral Fees prio to the due date specified by us.

Immediately after the expiration of a domini name i befoe the deletion of the domini name in the applicable Registry's database, you ackaraledge that we may direct the domini name to name servers i/o IP addresses designated by us, including, without limitation, to no IP address o to an IP address which hosts a parking page o a search engine page that may display advertisements o other content, i you ackaraledge that we may either leave el teu infomation intact o that we may change el teu infomation fo the expired domini name so that you are no longer the listed as the Registrant o Administrative Contacte of the expired domini name.

Renovaral i Redemption Process fo TLDs under ICANN Sponsoship: Fo a period of 29 days after the expiration of the term of el teu domini name, you ackaraledge that we may provide a procedure by which el teu expired domini name may be renewed. You ackaraledge i agree that we may, but is not obligated to, offer this process, called the Renovaral Period ("RP". You ackaraledge that you assume all risks i all consequences if you wait until close to, o after, the expiration of the oiginal term of the domini name, to attempt to renew the domini name. You ackaraledge i agree that we may make expired domini names available to third parties i that expired domini names may be re-registrared to any party at any time.

You agree that we are not obliged to contact you to alert you that the Services are being terminated if you choose not to pay the redemption fee. After the end of the RGP, if you do not exercise el teu rights under this section, you agree that you have abioned the domini name, i relinquish all rights to, i use of, the domini name.

You ackaraledge that the renewal, redemption, i restoation processes available from ccTLD Registries are varied i are subject to each respective Registry's policies i procedures. In any case, we may o may not provide access to these processes, at its sole i absolute discretion.

15. Auto-Renovaral

You ackaraledge that, even though we may provide an auto-renewal servei to you fo el teu convenience, it is el teu sole responsibility to keep el teu own recods i to maintain el teu own reminders regarding when el teu Services are set to expire to ensure that el teu Renovaral Fees are paid fo the Services prio to the due date, including any serveis provided fo under the Master Service Agreement o any other agreement with us. We are in no way liable o responsible fo failure of the auto-renewal servei to pay el teu Renovaral Fees to renew the Services by the due date.

16. Dispute Policies

As a condition to entering into this Agreement with us, you must agree to the Registry's policies i procedures fo the applicable TLD fo which you are submitting an application fo domini name registration o renewal, i if applicable, the policies i procedures of ICANN. As such, you agree to be governed by the dispute resolution policies adopted i promulgated by each respective Registry which you enter into an agreement with under this Agreement.

By entering into this Agreement by submitting an application to us fo any TLD under ICANN's sponsoship, you agree to be bound by the terms of ICANN's UDRP i URS Policies, which are incopoated aquíin i made part of this Agreement by reference.

17. Up to Date Infomation i its Use

You agree to provide current, complete, i accurate infomation about you, both with respect to el teu account infomation with us ("Account") i with respect to the WHOIS infomation fo el teu domini names under this Agreement. You agree to maintain i update this infomation within seven (7) days of any change as needed to keep it current, complete, i accurate. With respect to the administrative, technical, i billing contacts fo el teu domini names, you must submit the following: name, postal address, e-mail address, voice telephone number, i waquí available, fax number. You agree that the type of infomation you are required to provide may change i you ackaraledge that, if you do not provide the newly required infomation, el teu Services under this Agreement may be suspended o terminated o may not be renewed. Failure to provide complete i accurate infomation may anteriorent you from obtaining the Services. You may provide infomation regarding the name servers assigned to el teu domini names i, if we are providing name server serveis to you, the DNS settings fo the domini name. Si you do not provide complete name server infomation, you agree that we may supply this infomation fo you (i point el teu domini name to a website o IP address of our choosing) until such time as you elect to supply name server infomation.

You further agree that a public WHOIS database will be published, as required by ICANN i various Registries as part of their adopted WHOIS policies, containing the infomation you provide above in relation to this Agreement. The WHOIS database may publish infomation beyond many Registry requirements. You understi i ackaraledge that a number of Registries, such as CIRA i Nominet, limit el teu infomation to be publicly displayed in their WHOIS databases; Nosaltres public WHOIS database may not. You ackaraledge i agree that we will make available the Account infomation that you provide o that we otherwise maintain to the following parties: ICANN, various Registries, i other third parties as ICANN i applicable laws may require o permit (including through web-based i other on-line WHOIS lookup systems), whether during o after the term of el teu domini name under this Agreement. You aquíby irrevocably waive any i all claims i causes of action you may have arising from such disclosure o use of such infomation. Afegiritionally, you ackaraledge that ICANN, o various Registries, may establish o modify the guidelines, limits i/o requirements that relate to the amount i type of infomation that we may o must make available to the public o to private entities, i the manner in which such infomation is made available. Infomation regarding ICANN's guidelines i requirements regarding WHOIS can be found at http://www.icann.org/registrars/wmrp.htm, http://www.icann.org/registrars/wdrp.htm, i elsewaquí on the ICANN website at http://www.icann.org/index.html. You agree that we may make publicly available some, o all, of the infomation you provide, fo purposes of inspection (such as through the WHOIS servei), i other purposes as required o permitted by applicable laws.

You understi that it is impotant fo you to regularly monito email sent to the email address associated with el teu account i WHOIS contact infomation because, among other reasons, if a dispute arises regarding el teu domini name o other related serveis, you may lose el teu rights to the domini name o el teu right to receive the Services if you do not respond appropriately to an email sent in conjunction taquíwith.

18. Ownership of Infomation i Data

You agree i ackaraledge that we, NiceNIC.NET, o each respective Registry own all database, compilation, collective i similar rights, title i interests woldwide in our databases, i all infomation i derivative woks generated from the databases.

In regards to the Services, you agree i ackaraledge that we, NiceNIC.NET, o each respective Registry who provides the Services, owns the following infomation fo those Services: (a) the oiginal creation date of the registration, (b) the expiration date of the registration, (c) the name, postal address, e-mail address, voice telephone number, i waquí available fax number of all contacts fo the domini name registration, (d) any remarks concerning the registrared domini name that appear o should appear in the WHOIS o similar database, i (e) any other infomation we generate o obtain in connection with the provision of the Services, other than the domini name being registrared, the IP addresses of the primary name server i any secondary name servers fo the domini name, i the coresponding names of those name servers. We do not have any ownership interest in el teu specific personal registration infomation outside of our rights in our domini name database.

19. Període i Períodeination

This Agreement shall commence on the first day that Services are paid i applied fo i shall remain in foce continuously i uninterrupted so long as el teu Services are active.

You may terminate this Agreement at any time. Per terminate this Agreement, you must contact suppot i request termination. Upon termination, we shall terminate the Services. You ackaraledge that we are required to retain certain recods i infomation related to el teu Services accoding to local, state, country i international laws i will archive the infomation only as it is legally required to do so fo this limited purpose.

We reserve the right to stop offering registration o renewal Services fo any gTLD, sTLD, IDN, o ccTLD offered under this Agreement at any time. In such case that we stop offering the Services, you shall have the right to transfer the domini name to another registrar if this option is available. We shall not be liable in any way fo its decision to stop offering the registration i renewal Services.

You agree that el teu failure to respond in seven (7) calendar days to inquiries by us concerning the accuracy of el teu Account infomation i WHOIS contact infomation o violations of any terms of this Agreement shall constitute a material breach of this Agreement i will be sufficient basis fo suspension, cancellation, o termination of the domini name registration Services, including cancellation i deletion of the domini name, under this Agreement.

20. Afegiritional Rights

We expressly reserve the right to deny, cancel, terminate, suspend, lock, o modify the Services provided under this Agreement, including cancellation i deletion of the domini name, o any other agreement with us fo any reason, at our sole i absolute discretion, including, but not limited to the following: (i) to corect mistakes made in the offering i sale of the Services; (ii) to protect the stability of the Services i our systems; (iii) to address fraud i abuse issues; (iv) to comply with local, state, national, international laws, rules i regulations; (v) to comply with requests of law enfocement; (vi) to comply with a dispute resolution process; (vii) to avoid any civil o criminal liability; o (viii) to comply with registry o vendo requirements.

21. Indemnification

You agree to release, defend, indemnify i hold us harmless, our parent companies, subsidiaries, affiliates, shareholders, agents, directos, officers, i employees from i against any i all claims, demis, liabilities, losses, damages, charges o costs, including reasonable attoney's fees, however so incurred arising out of o related in any way to a breach by you of any of the terms of this Agreement o el teu use of the Services ("Claims").

You further agree to indemnify, defend, i hold harmless applicable Registry operatos (including, but not limited to, VeriInicia sessióc., Neustar, Inc., Public Interest Registry, Afilias Limited, Donuts, Rightside Registry, Uniregistry, Inc., Cocca, i other registry operatos listed at http://www.icann.org/registries/listing.html) i all such parties' directos, officers, employees, i agents from i against any i all claims, damages, liabilities, costs, i expenses (including any direct, indirect, incidental, special o consequential damages, i reasonable legal fees i expenses) arising out of, o related to, the Services you are obtaining from us.

22. Warranty Disclaimer

WE, OUR SUBSIDIARIES, AFFILIATES, SHAREHOLDERS, AGENTS, DIRECTOS, OFFICERS, AND EMPLOYEES EXPRESSLY DISCLAIM ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND IN CONNECTION WITH THIS AGREEMENT, THE SERVICES PROVIDED HEREUNDER, THE SITE O ANY WEB SITES LINKED TO THE SITE, WHETHER EXPRESS O IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FO A PARTICULAR PURPSOE AND NON-INFRINGEMENT, EXCEPT FO OUR STATEMENT REGARDING OUR ACCREDITATION AS ICANN-APPROVED DOMAIN NAME REGISTRAR. ALL SERVICES, AS WELL AS THE SITE, ARE PROVIDED "AS IS". YOUR SUBSCRIPTION TO, AND USE OF, OUR SERVICES AND OUR SITE ARE ENTIRELY AT YOUR RISK. 24. General

Si you do not agree to be bound by this Agreement as last revised as indicated by the "Last Revised" date located at the bottom of this Agreement, do not use o continue to use the Services. 25. Notices
You agree that any notices required to be given under this Agreement by us to you will be deemed to have been given if delivered in accodance with the Account i/o WHOIS infomation you have provided.

26. Governing Law
This Agreement i its subject matter shall be governed in accodance with the laws of Hong Kong i subject to the exclusive jurisdiction of the Hong Kong courts without regard to conflict of laws i principles contained taquíin with the exception of disputes related to this Agreement which fall under UDRP, URS, o similar dispute resolution process as defined by various Registry policies incopoated o made reference to aquíin.

a) The Customer must guarantee that he has checked that the domini it has applied fo does neither violates any third-party rights (trademarks, rights to names i copyrights), does not violate statutoy prohibitions o public oder i that he is not using the domini fo illegal purposes, in particular phishing i spamming.

The Customer must put himself under the obligation not to publish on the website filed under the domini any contents violating statutoy prohibitions, trademark rights, rights to names, copyrights o public oder.

b) The Customer must put himself under the obligation to immediately infom NICENIC INTERNATIONAL GROUP CO., LIMITED in writing by post, fax o email about all registration related occurrences concerning the domini, in particular the threat o the initiation of legal measures.

Si the holder of the domini changes while maintaining NICENIC INTERNATIONAL GROUP CO., LIMITED as provider then the new holder must accept "NiceNIC .HK Trustee Service Períodes".

In case of a change in the domini owner i a simultaneous change to another provider than NICENIC, the "NiceNIC .HK Trustee Service Períodes" will automatically cease.

With any change from NICENIC INTERNATIONAL GROUP CO., LIMITED to another provider, the "NiceNIC .HK Trustee Service Períodes" will cease.

Si the Customer does not designate a new Registrant prio to the change of provider then NICENIC INTERNATIONAL GROUP CO., LIMITED may reject the change of provider.

c) The Customer must put himself under the obligation to answer enquiries from NiceNIC relating to domini registration immediately by post o fax o email, i reaching NiceNIC at the latest within 48 hours. The deadline will be shotened accodingly, if deadlines are set in a legally valid way by a third party (claimant, court, administrative agency etc.).

The Customer is obliged to keep his contact data constantly up to date with NICENIC INTERNATIONAL GROUP CO., LIMITED i expressly authoises NICENIC to make such contact data available to Registry of HKIRC i ICANN.

Si the contact data provided by the Customer to NICENIC INTERNATIONAL GROUP CO., LIMITED, in particular the Correu electrònic Adre?a, postal address i the telephone number, are not corect i if the Customer is not reachable via the contact routes he provided o if he does not answer an enquiry from NICENIC within a deadline set then NiceNIC is entitled to make any decisions, in particular to delete the domini.

2. Obligations of NICENIC

a) NICENIC has put himself in relation to NICENIC INTERNATIONAL GROUP CO., LIMITED under the obligation to accomplish the tasks incumbent upon him as an administrative contact accoding to the best of his karaledge i belief. He will abide by coresponding instructions from NICENIC INTERNATIONAL GROUP CO., LIMITED provided the latter do not run counter to the law.

b) NICENIC will, when decisions may o have to be made without consulting the Customer, make such decisions accoding to his equitable discretion.

3. Settlement of disputes with third parties

Si NICENIC is sued as representative of the Customer o directly by a third party fo release o deletion of the domini then the Customer must within the deadlines declare in writing whether he will consent to release o whether he wishes to defend the domini.

a) Si the Customer consents to release then NICENIC INTERNATIONAL GROUP CO., LIMITED will declare deletion of the domini i infom the third party o the claimant.

b) Si the Customer fails to provide a declaration in time then NICENIC INTERNATIONAL GROUP CO., LIMITED will be entitled to immediately delete the domini.

c) Si the Customer infoms NICENIC that he wishes to defend the domini then he must deposit with him within two days a bond (cash payment in USD o perfomance bond of HSBC) in the amount to be determined in equitable discretion by NICENIC INTERNATIONAL GROUP CO., LIMITED, patterned on the Judicial Costs Act as well as, possibly, on damage compensation claims to be expected, which bond covers the potential compensation ]]>

1 DOMAIN NAME SERVICES

1.1 The Registrant shall at all times comply with all anteriorailing requirements prescribed by HKIRC in connection with any of the .hk o.香港 domini name (the "Nom de domini"), i shall only request the Registrador Services in the fom i manner prescribed by HKIRC from time to time.

1.2 In registraring a Nom de domini, the Registrant ackaraledges i agrees that neither HKIRC no NICENIC International Group Co., Limited (the "Registrador") has made any determination with respect to the legality of the Nom de domini registration o its use.

1.3 The Registrant ackaraledges i agrees that the Registrador shall monito the status of Noms de domini registrared through the Registrador i shall, at its own initiative o on receipt of complaint, conduct checks to verify whether a Nom de domini is being used in connection with phishing o "spam" advertising. The Registrador shall delete o suspend a Nom de domini if so directed by HKIRC. HKIRC may issue such a direction on receipt of any notice from any government o law enfocement authoity (including without limitation the Hong Kong Police Foce o the Office of Telecommunications Authoity) that the use of the Nom de domini is in breach of any laws, directives, guidelines, codes of practice o regulations issued by such local authoities, o if, in HKIRC's reasonable belief, the continuation of registration of the Nom de domini o the operation of web site referenced   by the Nom de domini is likely to damage o adversely affect the goodwill, reputation i operation of HKIRC o the domini name industry in Hong Kong, o may expose HKIRC to risks of third party claims o civil o criminal prosecution.

2 PUBLICATION OF REGISTRANT PERSONAL DATA

2.1 The Registrant ackaraledges i agrees that HKIRC is entitled to publicly disclose to third parties all personal data i infomation relating to the registrared Nom de domini in oder to enable HKIRC to maintain a public WHOIS servei, provided that such disclosure is consistent with:

    (a) the Personal Data (Privacy) Ordinance; i
    (b) the Publicat Policies of HKIRC; i
    (c) this Registre Agreement.

2.2 The Registrant grants to the Registrador the right to disclose to the HKIRC all infomation which is reasonably required by HKIRC in oder to enter the Nom de domini into the Registry.

3 CHANGE OF REGISTRARS

3.1 The Registrador shall not anteriorent a Registrant from changing the registrar of recod, except in accodance with the Registre Policies.

3.2 The Registrador shall ensure that the Registrant can easily transfer registrared Noms de domini to another registrar in accodance with the Publicat Policies of HKIRC.

3.3 In the event that:
       
    3.3.1 the Registrador is no longer a registrar; o
    3.3.2 the Registrador's HKIRC Acreditació is suspended o terminated; o
    3.3.3 the Registrador Agreement is terminated by HKIRC, the Registrador shall immediately give notice to its Registrants, i advise the Registrants that they should transfer the registrared Nom de domini to a new registrar.

3.4 In the event that the Registrador Agreement between HKIRC i the Registrador is terminated due to default o breach of the Registrador, the Registrador must not charge the Registrant any fee fo the transfer of the registrared Nom de domini to another registrar. The Registrador shall take all necessary actions to preserve the rights of its Registrants.

3.5 Si the Registrant of a Nom de domini registrared under Hong Kong Netwok Infomation Centre ("HKNIC") Registre Agreement Version 1.x o 2.xx elects to change the Registrador from Hong Kong Domini  Nom Registre Company Limited ("HKDNR") to another Registrador ("Nou Registrador"), the Registrant shall ackaraledge i accept that the Nom de domini registration will be subject to the terms i conditions of the then current registration agreement of the Nou Registrador. Fo the avoidance of doubt, if the Nom de domini registration is under one of the above-mentioned agreements, the Contract Version field of the WHOIS result display fo that Nom de domini will display the wod "Old"

3.6 The Registrant shall provide an authoization code ("Authoization Infomation") to a new registrar in oder to initiate the change of registrar. The Registrador can request that HKIRC provide this Authoization Infomation by sending it to the Registrant's email address. The Registrador shall not, if requested to do so by a Registrant, refuse to make such a request of HKIRC.

3.7 In the event that the Registrador is no longer an HKIRC-Accredited registrar, the Nom de domini held by a Registrant shall be transferred to another, HKIRC-Accredited registrar within a specified period of time. Si the Registrant fails to elect a registrar i effect the transfer, HKIRC shall be entitled to transfer the Nom de domini to registration with HKDNR, together with any personal data held by the anteriorious Registrador in relation to that Registrant.

4 REGISTRANT'S OTHER OBLIGATIONS

4.1 Throughout the Període of the Registre Agreement, the Registrant must:
    
    4.1.1 comply with the Publicat Policies (including but not limited to the Registre Policies, Procedures i Guidelines, Nom de domini Dispute Resolution Policy i Rules of Procedure i the Registre Agreement. The Publicat Policies can be found on either the web site of HKIRC, www.hkirc.hk o the web site of NiceNIC, http://nicenic.net/domini/hk-domini-registration.php;
    4.1.2 give notice to HKIRC, through the Registrador, of any change to any infomation in the Registrant Data as soon as possible.

4.2 The Registrant shall not, directly o indirectly, through registration o use of its Nom de domini o otherwise:

    4.2.1 infringe o violate the legal rights of any third party; o
    4.2.2 violate any applicable laws i regulations.

4.3 The Registrant ackaraledges i agrees that HKIRC may collect registrant infomation fo the purpose of HKIRC membership.

5 DISPUTE RESOLUTION

5.1 Fo any Nom de domini registrared with the Registrant that is challenged by a third party, the dispute will be hiled accoding to the provisions of the Nom de domini Dispute Resolution Policy fo .hk i .香港 Noms de domini.

5.2 Any decision made by an arbitration panel duly appointed by a dispute resolution servei provider shall be final i binding on the Registrant i the Registrant shall abide by such decision.

6  REGISTRANT WARRANTIES 


6.1 The Registrant warrants that it meets, i continues to meet, the eligibility criteria prescribed in HKIRC's Publicat Policies i this Registre Agreement fo registraring a Nom de domini. In the event that the Registrant ceases to meet such eligibility criteria, the Nom de domini registration may be terminated by either the Registrador o HKIRC.

6.2 By making an application fo a Nom de domini, the Registrant represents i warrants that:
    
    (a) to the best of its karaledge i belief, the Nom de domini that the Registrant is applying fo will not infringe o otherwise violate the legal rights of any third party;
    (b) the Registrant intends to use the Nom de domini;
    (c) the Registrant's use of the Nom de domini shall be bona fide fo the Registrant's own benefit i shall be fo lawful purposes;
    (d) the Registrant will not karaingly use the Nom de domini in violation of any applicable laws i regulations;
    (e) all infomation the Registrant provides to the Registrador, including further additions o alterations to such infomation, is true, complete i accurate;
    (f) in the event that the Registrant receives notification of any claim, action o demi arising out of o related to the registration o use of the Nom de domini, the Registrant will immediately send the Registrador a written notice notifying the Registrador of such claim, action o demi.

    The Registrant ackaraledges that the Registrador i HKIRC rely on all representations made i warranties given by the Registrant in determining if the application fo a Nom de domini should be approved.

7. HKIRC Contacte Registrants

7.1 The Registrant ackaraledges that HKIRC may contact the Registrant in a number of situations including, but not limited to, inviting the Registrant to join HKIRC as a member; waquí taquí has been, o will be, a change in registrar, whether voluntarily o involuntarily on the part of the Registrant, due to termination of the Registrador; fo the matters in relation to the administration i servei of Noms de domini; inviting the Registrant to take part in a customer satisfaction survey o other survey, i introducing seminars, conferences, training, i other news related to the Internet industry. Si the Registrant does not want to receive unsolicited marketing o promotional emails, the Registrant can request that HKIRC remove the Registrant from the marketing o promotional email subscription list.

8. LIABILITIES

8.1 The Registrant shall indemnify i hold harmless HKIRC as the Registry from all liabilities, losses, damages, costs, legal expenses, professional i other expenses of any nature howsoever sustained, incurred, paid by o suffered by HKIRC which are directly o indirectly related to any claim, action, o demi arising out of o related to the registration o use of the Nom de domini brought by the Registrant.

8.2 Notwithstiing any other provision of this document i to the fullest extent permitted by law, HKIRC will not be liable to the Registrant fo consequential, indirect o special losses o damages of any kind (including, without limitation, loss of profit, loss o coruption of data, business interruption o indirect costs) suffered by the Registrant as a result of any act o omission whatsoever of HKIRC i the Registrador, its employees, agents o sub-contractos.

8.3 In no event shall HKIRC's maximum liability under these Registre Policies exceed 125% of the registration fees paid by the Registrador to HKIRC fo the Registrant's Nom de domini in respect of a particular period of registration.

In case of a change in the domini owner i a simultaneous change to another provider than NICENIC, the ""NiceNIC CN Series Registre de domini Trustee Service" will automatically cease.

With any change from NICENIC INTERNATIONAL GROUP CO., LIMITED to another provider, the "NiceNIC CN Series Registre de domini Trustee Service" will cease.

Si the Customer does not designate a new Registrant prio to the change of provider then NICENIC INTERNATIONAL GROUP CO., LIMITED may reject the change of provider.

c) The Customer must put himself under the obligation to answer enquiries from NiceNIC relating to domini registration immediately by post o fax o email, i reaching NiceNIC at the latest within 48 hours. The deadline will be shotened accodingly, if deadlines are set in a legally valid way by a third party (claimant, court, administrative agency etc.).

The Customer is obliged to keep his contact data constantly up to date with NICENIC INTERNATIONAL GROUP CO., LIMITED i expressly authoises NICENIC to make such contact data available to Registry of CNNIC i ICANN.

Si the contact data provided by the Customer to NICENIC INTERNATIONAL GROUP CO., LIMITED, in particular the Correu electrònic Adre?a, postal address i the telephone number, are not corect i if the Customer is not reachable via the contact routes he provided o if he does not answer an enquiry from NICENIC within a deadline set then NiceNIC is entitled to make any decisions, in particular to delete the domini.

2. Obligations of NICENIC

a) NICENIC has put himself in relation to NICENIC INTERNATIONAL GROUP CO., LIMITED under the obligation to accomplish the tasks incumbent upon him as an administrative contact accoding to the best of his karaledge i belief. He will abide by coresponding instructions from NICENIC INTERNATIONAL GROUP CO., LIMITED provided the latter do not run counter to the law.

b) Si the Customer fails to provide a declaration in time then NICENIC INTERNATIONAL GROUP CO., LIMITED will be entitled to immediately delete the domini.

c) Si the Customer infoms NICENIC that he wishes to defend the domini then he must deposit with him within two days a bond (cash payment in USD o perfomance bond of HSBC) in the amount to be determined in equitable discretion by NICENIC INTERNATIONAL GROUP CO., LIMITED, patterned on the Judicial Costs Act as well as, possibly, on damage compensation claims to be expected, which bond covers the potential compensation.

The TDRP i coresponding procedures will apply to all domini names fo which transfer requests are submitted on o after the effective date of this policy.

1. Definitions

1.1 Dispute Resolution Panel

     The Dispute Resolution Panel shall mean an administrative panel appointed by a Dispute Resolution Provider ("Provider") to decide a Request fo Enfocement concerning a dispute under this Dispute Resolution Policy.

1.2 Dispute Resolution Provider

1.3 The Dispute Resolution Provider must be an independent i neutral third party that is neither associated no affiliated with either Registrador involved in the dispute o the Registry Operato under which the disputed domini name is registrared. ICANN shall have the authoity to accredit one o moe independent i neutral Dispute Resolution Providers accoding to criteria developed in accodance with this Dispute Resolution Policy.

1.4 FOA

     Fom of Authoization - The stiardized fom of consent that the Gaining Registrador i Registrador of Recod are required to use to obtain authoization from the Registrant o Administrative Contacte in oder to properly process the transfer of domini name sponsoship from one Registrador to another.

1.5 Gaining Registrador

     The Registrador that submitted to the Registry the request fo the transfer of a domini sponsoship from the Registrador of Recod.

1.6 Registrador of Recod

     The Registrador of Recod fo a domini name fo which the Registry received a transfer of sponsoship request.

1.7 Registrant

     The Registrant is the individual o oganization that registrars a specific domini name. This individual o oganization holds the right to use that specific domini name fo a specified period of time, provided certain conditions are met i the registration fees are paid. This person o oganization is the "legal entity" bound by the terms of the relevant servei agreement with the Registry operato fo the TLD in question.

1.8 Registry (Registry Operato)

     The oganization authoized by ICANN to provide registration serveis fo a given TLD to ICANN-accredited Registradors.

1.9 Supplemental Rules

     The Supplemental Rules shall mean those rules adopted by the Registry Operato, in the case of First Nivell disputes (as set foth below), o the Provider administering a proceeding (in the case of all other disputes) to supplement this Policy. Supplemental Rules shall be consistent with this Dispute Resolution Policy i shall cover topics such as fees, wod i page limits i guidelines, the means fo communicating with the Provider, i the fom of cover sheets.

1.10 Transfer Policy

     The Policy on Transfer of Sponsoship of Registres between Registradors which is in foce as part of the Registry-Registrador Agreement executed between a Registrador i the Registry, as well as the Registrador Acreditació Agreement which is executed between ICANN i all ICANN- accredited registrars.

2. Dispute Resolution Process

     Taquí are two possible steps to the Registrador Transfer Dispute Resolution Process. A Registrador may elect one o both of the steps pursuant to the rules below. In the event a Registrador either files a Request fo Enfocement (as described below) with a Second-Nivell Dispute Provider, o files an Appeal (as described below) with a Dispute Provider, it may not revert to the First-Nivell Registry option later fo the same filing o matter presented fo resolution.

2.1 First Nivell - Registry Operato

     A Registrador may choose to file a dispute directly with the relevant Registry Operato. Any decisions made by the Registry Operato may be appealed to a Dispute Resolution Provider. A Registrador may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing Registrador would fofeit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-Nivell - Dispute Resolution Panel

     The primary intent of this step is to provide a means fo registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case waquí a Registrador of Recod alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case waquí a Gaining Registrador alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First Nivell (Registry)

3.1 Registrador files a Request fo Enfocement with the applicable Registry Operato

     3.1.1 Either the Gaining o Registrador of Recod ("Filing Registrador") may submit a Request fo Enfocement. This must be done in accodance with the Supplemental Rules adopted by the applicable Registry Operato.

     3.1.2 The Request fo Enfocement shall be submitted to the Registry i to the Respondent (the Non-filing Registrador) in electronic fom i shall:
     (i) Request that the Request fo Enfocement be submitted fo decision in accodance with the Registrador Transfer i Dispute Resolution Policy i the applicable Supplemental Rules;
     (ii) Provide the name, postal i e-mail addresses, i the telephone i fax numbers of the Filing Registrador i those representatives authoized by the Filing Registrador to act on behalf of the Filing Registrador in the administrative proceeding;
     (iii) Provide the name of the Respondent i all infomation (including any postal i e-mail addresses i telephone i fax numbers) karan to Filing Registrador regarding how to contact Respondent o any representative of Respondent, including contact infomation based on pre-complaint dealings;
     (iv) Specify the domini name(s) that is/are the subject of the Request fo Enfocement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accodance with the Policy, the grounds on which the Request fo Enfocement is based;
     (vii) State the specific remedy being sought (either approval o denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced o terminated in connection with o relating to any of the domini name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fo Enfocement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent o transmitted to the Respondent; i
     (x) Conclude with the following statement followed by the signature of the Complainant o its authoized representative:
           "<insert name of Filing Registrador> agrees that its claims i remedies concerning the registration of the domini name, the dispute, o the dispute's resolution shall be solely against the Respondent i waives all such claims i remedies against the Registry Operato as well as its directos, officers, employees, i agents, except in the case of deliberate wrongdoing o gross negligence."
           "<insert name of Filing Registrador> certifies that the infomation contained in this Request fo Enfocement is to the best of Filing Registrador's karaledge complete i accurate, that this Request fo Enfocement is not being presented fo any improper purpose, such as to harass, i that the assertions in this Request fo Enfocement are warranted under this Policy i under applicable law, as it ara exists o as it may be extended by a good-faith i reasonable argument."3.1.3 The Request fo Enfocement may relate to moe than one domini name, provided that the domini names involve the same Filing Registrador i Respondent i that the claims arise out of the same o similar factual circumstances.

3.1.4 The Request fo Enfocement shall annex the following documentary evidence (as applicable i available) in electronic fom if possible, together with a schedule indexing such evidence:
  (i) Fo the Gaining Registrador:
      a. Completed Fom of Authoization ("FOA")
      b. Copy of the Whois output fo the date transfer was initiated, which was used to identify the authoized Transfer Contactes
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body o court oder in cases when the Registrant of Recod is being changed simultaneously with a Registrador Transfer
      e. Copies of all communications made to the Registrador of Recod with regard to the applicable transfer request along with any responses from the Registrador of Recod
  (ii) Fo the Registrador of Recod:
      a. Completed FOA from Registrador of Recod if applicable
      b. Copy of the Whois output fo the date the transfer was initiated
      c. Relevant histoy of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

  • fraud;
  • UDRP action;
  • court oder;
  • Registrant o administrative contact identity dispute in accodance with Section 4 [Registrador of Recod Requirements]
  • applicable payment dispute along with evidence that the registration was put on HOLD status;
  • express written objection from the Registrared Nom Holder o Administrative Contacte;
  • LOCK status along with proof of a reasonable means fo the registrant to remove LOCK status as per Section __of Exhibit __ to this Agreement;
  • domini name within 60 days of initial registration; o
  • domini name within 60 days of a prio transfer.

      e. Copies of all communications made to the Gaining Registrador with regard to the applicable transfer request along with any responses from the Gaining Registrador.

3.2 The Non-Filing Registrador ("Respondent") shall have seven (7) calendar days from receipt of the Request fo Enfocement to prepare a Response to the Request fo Enfocement ("Response").

3.2.1 The Response shall be submitted in electronic fom to both the Registry i Filing Registrador i shall:
      (i) Respond specifically to the statements i allegations contained in the Request fo Enfocement (This potion of the response shall comply with any wod o page limit set foth in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal i e-mail addresses, i the telephone i fax numbers of the Respondent (non-filing Registrador);
      (iii) Identify any other legal proceedings that have been commenced o terminated in connection with o relating to any of the domini name(s) that are the subject of the Request fo Enfocement;
      (iv) State that a copy of the Response has been sent o transmitted to the Filing Registrador;
      (v) Conclude with the following statement followed by the signature of the Respondent o its authoized representative:
   "Respondent certifies that the infomation contained in this Response is to the best of Respondent's karaledge complete i accurate, that this Response is not being presented fo any improper purpose, such as to harass, i that the assertions in this Response are warranted under these Rules i under applicable law, as it ara exists o as it may be extended by a good-faith i reasonable argument."; i
     (vi) Annex any documentary o other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 A the request of the Respondent, the Registry Operato may, in exceptional cases, extend the period of time fo the filing of the response, but in no case may the extension be moe than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operato.

3.2.3 Si a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operato shall decide the dispute based upon the Request fo Enfocement.

3.3 Registry Operato must review all applicable documentation i compare registrant/contact data with that contained within the authoitative Whois database i reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 Si the data included in the Request fo Enfocement does not match the data listed in the authoitative Whois, the Registry Operato must contact each Registrador i require additional documentation.

3.3.2 Si the Gaining Registrador cannot provide a complete FOA with data matching that contained within the authoitative Whois database, then the Registry Operato shall find that the transfer should be reversed. In the case of a thick Registry, if the Registrador of Recod's Whois is not accessible o invalid, the Registry Operato's Whois should be used. In the case of a thin Registry, if the Registrador of Recod's Whois is not accessible o is invalid, the Registry Operato must notify ICANN i place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case waquí a Registrador of Recod denies a request fo a domini name transfer ("NACKs"), the Registrador of Recod must provide evidence of one of the factos fo which it is allowed to NACK. Si the Registrador of Recod cannot provide evidence that demonstrates any of the factos, i the Gaining Registrador provides to the Registry a complete FOA with data matching that contained within the authoitative Whois database, then the transfer must be approved to be processed.

3.3.4 Si the data provided by neither Registrador appears to be conclusive, then the Registry shall issue a finding of "no decision." Si the data provided to the Registry is complete i provides sufficient basis fo a determination based on the Policy, the Registry may not issue a finding of "no decision." Either Registrador shall be able to appeal such issue to a Second-Nivell Dispute Resolution Provider in accodance with the provisions set foth below.

3.4 Fees fo First-Nivell Dispute Resolution Service

3.4.1 Taquí is no filing fee assessed to the Filing Registrador at the time the Request fo Enfocement is submitted to the Registry Operato.

3.4.2 The Registrador that does not anteriorail in the dispute will be assessed a fee to be set by the Registry Operato. Such fee shall be set foth in the Registry's Supplemental Rules that are in effect at the time that the Request fo Enfocement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operato shall collect the applicable fees from the Filing Registrador.

3.5 Availability of Court Proceedings

      The procedures set foth above shall not anteriorent a Registrador from submitting a dispute to a court of competent jurisdiction fo independent resolution befoe such an administrative proceeding is commenced o after such proceeding is concluded. Si a Registry Operato decides a domini name registration should be transferred (either to the Gaining Registrador, o alternatively, back from the Gaining Registrador to the Registrador of Recod), the Registry will wait fourteen (14) calendar days after it is infomed of the decision befoe implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted domini name(s). Si such documentation is received by the Registry Operato within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operato that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operato that the lawsuit has been dismissed o withdrawn; o (iii) the Registry Operato receives a copy of an oder from such court.

4. Dispute Procedures at the Second Nivell with a Dispute Resolution Provider

4.1 The serveis of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing Registrador may elect to skip the First-Nivell dispute process at Registry level i submit a Request fo Enfocement directly with a Dispute Resolution Provider;
      (ii) The non-anteriorailing Registrador in a First-Nivell dispute proceeding may submit an appeal of the applicable Registry Operato's decision to the Dispute Resolution Provider. Afegiritionally, in the case waquí the result in the First-Nivell dispute process is a "no-decision," either Registrador may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fo Enfocement

4.2.1 In the event that the Filing Registrador elects to submit a Request fo Enfocement to the Dispute Resolution Provider in lieu of submitting a Request fo Enfocement to the applicable Registry Operato, the obligations i responsibilities set foth in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation i compare registrant/contact data with that contained within the authoitative Whois database i reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) Si the data does not match the data listed in authoitative Whois, the Dispute Resolution Panel should contact each Registrador i require additional documentation.
     (ii) Si the Gaining Registrador is unable to provide a complete FOA with data matching that contained within the authoitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the Registrador of Recod's Whois is not accessible o invalid, the applicable Registry Operato's Whois should be used. In the case of a thin Registry, if the Registrador of Recod's Whois is not accessible o is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case waquí a Registrador of Recod NACKs a transfer, the Registrador of Recod must provide evidence of one of the factos fo which it is allowed to NACK as set foth in Section 3.1.4 (ii) of this Dispute Resolution Policy. Si the Registrador of Recod cannot provide evidence that demonstrates any of the factos, i the Gaining Registrador provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authoitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-Nivell dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies i determine, based on a preponderance of the evidence, which Registrador should anteriorail in the dispute i what resolution to the Request fo Enfocement will appropriately redress the issues set foth in the Request fo Enfocement.
     (v) Resolution options fo the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (o odering the domini name be returned to the Registrador of Recod in cases waquí a Transfer has already occurred)

4.3 Appeal of First Nivell Dispute Decision o Registry Operato Finding of "No-Decision."

4.3.1 In the event that the Registrador which does not anteriorail in the First-Nivell dispute is dissatisfied by the Registry-Operato's decision, such Registrador may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Nivell decision was issued.

4.3.2 In the event that the Registry Operato issues a finding of "no-decision" in accodance with Section 3.3.4 above, either Registrador may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Nivell decision was issued.

4.3.3 In either case, the document submitted by the Registrador to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fom i shall:
     (i) Request that the Appeal be submitted fo decision in accodance with the Policy i these Rules;
     (ii) Provide the name, postal i e-mail addresses, i the telephone i telefax numbers of the Appellant i of any representative authoized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee i all infomation (including any postal i e-mail addresses i telephone i telefax numbers) karan to Appellee regarding how to contact Appellee o any representative of Appellee, including contact infomation based on pre-Request fo Enfocement i pre-Appeal dealings;
     (iv) Specify the domini name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fo such appeal, including specific responses to the findings of the Registry Operato in the First-Nivell Dispute process. (This potion of the response shall comply with any wod o page limit set foth in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accodance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings karan to the Appellant that have been commenced o terminated in connection with o relating to any of the domini name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent o transmitted to the Appellee; i
      (x) Conclude with the following statement followed by the signature of the Appellant o its authoized representative:
  "Appellant agrees that its claims i remedies concerning the registration of the domini name, the dispute, o the dispute's resolution shall be solely against the Appellee i waives all such claims i remedies against the Dispute Resolution Provider i the Registry Operato as well as their directos, officers, employees, i agents, except in the case of deliberate wrongdoing o gross negligence."
  "Appellant certifies that the infomation contained in this Appeal is to the best of Appellant's karaledge complete i accurate, that this Appeal is not being presented fo any improper purpose, such as to harass, i that the assertions in this Appeal are warranted under this Policy i under applicable law, as it ara exists o as it may be extended by a good-faith i reasonable argument."

4.3.5 The Appeal may relate to moe than one domini name, provided that the domini names involve the same decision issued by the Registry Operato fo the First-Nivell Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operato during the First-Nivell Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-Nivell Dispute from the applicable Registry Operato no later than seven (7) calendar days of receipt of the appeal. The Registry Operato shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation i reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant o Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De Novo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operato in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy i determine the appropriate resolution to the issues presented.

  • Approval of a Transfer
  • Denial of the Transfer (o odering the domini name be returned to the Registrador of Recod in cases waquí a Transfer has already occurred)

4.4 Fees fo Second-Nivell Dispute Resolution Service

4.4.1 In the case of either a Request fo Enfocement o an Appeal filed at the Second Nivell, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms i conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing Registrador o Appellant, whichever applicable, does not anteriorail in a Second-Nivell dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing Registrador o Appellant, whichever applicable, anteriorails in a Second-Nivell dispute, the Respondent o Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing Registrador o Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent o Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accodance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set foth above shall not anteriorent a Registrador from submitting a dispute to a court of competent jurisdiction fo independent resolution befoe such administrative proceeding is commenced o after such proceeding is concluded. Si a Dispute Resolution Panel decides a domini name registration should be transferred (either to the Gaining Registrador, o alternatively, back from the Gaining Registrador to the Registrador of Recod), such Registrador will wait fourteen (14) calendar days after it is infomed of the decision befoe implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted domini name(s). Si such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed o withdrawn; o (iii) a copy of an oder from such court dismissing the lawsuit o odering certain actions with respect to the domini name.

1. Registrador Requirements

     Registrared Nom Holders must be able to transfer their domini name registrations between Registradors provided that the Gaining Registrador's transfer process meets the minimum stiards of this policy i that such transfer is not prohibited by ICANN o Registry policies. Inter-Registrador domini name transfer processes must be clear i concise in oder to avoid confusion. Further, Registradors should make reasonable effots to infom Registrared Nom Holders of, i provide access to, the published documentation of the specific transfer process employed by the Registradors.

1.1 Transfer Authoities

     The Administrative Contacte i the Registrared Nom Holder, as listed in the Losing Registrador's o applicable Registry's (waquí available) publicly accessible WHOIS servei are the only parties that have the authoity to approve o deny a transfer request to the Gaining Registrador. In the event of a dispute, the Registrared Nom Holder's authoity supersedes that of the Administrative Contacte.
Registradors may use Whois data from either the Registrador of Recod o the relevant Registry fo the purpose of verifying the authenticity of a transfer request; o from another data source as determined by a consensus policy.

2. Gaining Registrador Requirements

Fo each instance waquí a Registrared Nom Holder requests to transfer a domini name registration to a different Registrador, the Gaining Registrador shall:
      2.1 Obtain express authoization from either the Registrared Nom Holder o the Administrative Contacte (aquíafter, "Transfer Contacte"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining Registrador from the Transfer Contacte.

     2.1.1 The authoization must be made via a valid Stiardized Fom of Authoization (FOA). Taquí are two different FOA's available at the ICANN website. The FOA labeled "Initial Authoization fo Registrador Transfer" must be used by the Gaining Registrador to request an authoization fo a registrar transfer from the Transfer Contacte. The FOA labeled "Confirmaation of Registrador Transfer Request" may be used by the Registrador of Recod to request confirmation of the transfer from the Transfer Contacte.
The FOA shall be communicated in English, i any dispute arising out of a transfer request shall be conducted in the English language. Registradors may choose to communicate with the Transfer Contacte in additional languages. However, Registradors choosing to exercise such option are responsible fo the accuracy i completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining Registrador relies on a physical process to obtain this authoization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer Contacte i further that it is accompanied by a physical copy of the Registrador of Recod's Whois output fo the domini name in question.

     2.1.2.1 Si the Gaining Registrador relies on a physical authoization process, then the Gaining Registrador assumes the burden of obtaining reliable evidence of the identity of the Transfer Contacte i maintaining appropriate recods proving that such evidence was obtained. Further the Gaining Registrador also assumes the burden fo ensuring that the entity making the request is indeed authoized to do so. The acceptable foms of physical identity are:

  • Notarized statement
  • Valid Drivers license
  • Passpot
  • Article of Incopoation
  • Military ID
  • State/Government issued ID
  • Birth Certificate

     2.1.3 In the event that the Gaining Registrador relies on an electronic process to obtain this authoization the acceptable foms of identity would include:

  • Electronic signature in confomance with national legislation, in the location of the Gaining Registrador (if such legislation exists).
  • Consent from an individual o entity that has an email address matching the Transfer Contacte email address. 

     The Registrador of Recod may not deny a transfer request solely because it believes that the Gaining Registrador has not received the confirmation set foth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining Registrador. The presumption in all cases will be that the Gaining Registrador has received i authenticated the transfer request made by a Transfer Contacte.

     2.2 Request, by the transmission of a "transfer" commi as specified in the Registrador Perol Kit, that the Registry Operato database be changed to reflect the new Registrador.

     2.2.1 Transmission of a "transfer" commi constitutes a representation on the part of the Gaining Registrador that the requisite authoization has been obtained from the Transfer Contacte listed in the authoitative Whois database.

     2.2.2 The Gaining Registrador is responsible fo validating the Registrared Nom Holder requests to transfer domini names between Registradors. However, this does not preclude the Registrador of Recod from exercising its option to independently confirm the Registrared Nom Holder's intent to transfer its domini name to the Gaining Registrador in accodance with Section 3 of this policy.

3. Obligations of the Registrador of Recod

     A Registrador of Recod can choose independently to confirm the intent of the Registrared Nom Holder when a notice of a pending transfer is received from the Registry. The Registrador of Recod must do so in a manner consistent with the stiards set foth in this agreement pertaining to Gaining Registradors. In oder to ensure that the fom of the request employed by the Registrador of Recod is substantially administrative i infomative in nature i clearly provided to the Transfer Contacte fo the purpose of verifying the intent of the Transfer Contacte, the Registrador of Recod must use the FOA.

     The FOA shall be communicated in English, i any dispute arising out of a transfer request, shall be conducted in the English language. Registradors may choose to communicate with the Transfer Contacte in additional languages. However, the Registrador choosing to exercise such option is responsible fo the accuracy i completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes i procedures set foth in this policy. This includes but is not limited to the requirement that no Registrador shall add any additional infomation to the FOA used to obtain the consent of the Transfer Contacte in the case of a transfer request.
This requirement does not preclude the Registrador of Recod from marketing to its existing customers through separate communications.
The FOA should be sent by the Registrador of Recod to the Transfer Contacte as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operato.Failure by the Registrador of Recod to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer Contacte listed in the Whois has not confirmed their request to transfer with the Registrador of Recod i the Registrador of Recod has not explicitly denied the transfer request, the default action will be that the Registrador of Recod must allow the transfer to proceed.
Upon denying a transfer request fo any of the following reasons, the Registrador of Recod must provide the Registrared Nom Holder i the potential Gaining Registrador with the reason fo denial. The Registrador of Recod may deny a transfer request only in the following specific instances:

  1. Evidence of fraud
  2. UDRP action
  3. Court oder by a court of competent jurisdiction
  4. Reasonable dispute over the identity of the Registrared Nom Holder o Administrative Contacte
  5. No payment fo anteriorious registration period (including credit card charge-backs) if the domini name is past its expiration date o fo anteriorious o current registration periods if the domini name has not yet expired. In all such cases, however, the domini name must be put into "Registrador Hold" status by the Registrador of Recod prio to the denial of transfer.
  6. Express written objection to the transfer from the Transfer Contacte. (e.g. - email, fax, paper document o other processes by which the Transfer Contacte has expressly i voluntarily objected through opt-in means)
  7. A domini name was already in “l(fā)ock status” provided that the Registrador provides a readily accessible i reasonable means fo the Registrared Nom Holder to remove the lock status.
  8. A domini name is in the first 60 days of an initial registration period.
  9. A domini name is within 60 days (o a lesser period to be determined) after being transferred (apart from being transferred back to the oiginal Registrador in cases waquí both Registradors so agree i/o waquí a decision in the dispute resolution process so directs).

Instances when the requested change of Registrador may not be denied include, but are not limited to:

  • Nonpayment fo a pending o future registration period
  • No response from the Registrared Nom Holder o Administrative Contacte.
  • Domini name in Registrador Lock Estat, unless the Registrared Nom Holder is provided with the reasonable oppotunity i ability to unlock the domini name prio to the Transfer Request.
  • Domini name registration period time constraints, other than during the first 60 days of initial registration o during the first 60 days after a registrar transfer.
  • General payment defaults between Registrador i business partners / affiliates in cases waquí the Registrared Nom Holder fo the domini in question has paid fo the registration.

     The Registrador of Recod has other mechanisms available to collect payment from the Registrared Nom Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the Registrador of Recod must not employ transfer processes as a mechanism to secure payment fo serveis from a Registrared Nom Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fo anteriorious registration period(s) if the transfer is requested after the expiration date, o
     (ii) In the case of non-payment of the current registration period, if transfer is requested befoe the expiration date.

4. Registrador Coodination

     Each Registrador is responsible fo keeping copies of documentation, including the FOA i the Transfer Contactes response taquíto, that may be required fo filing i suppoting a dispute under the dispute resolution policy. Gaining Registradors must maintain copies of the FOA as received from the Transfer Contacte as per the stiard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining Registrador i the Registrador of Recod must provide the evidence relied on fo the transfer during i after the applicable inter-registrar domini name transaction(s). Such infomation must be provided when requested by, i only by, the other Registrador that is party to the transfer transaction. Afegiritionally, ICANN, the Registry Operato, a court o authoity with jurisdiction over the matter o a third party dispute resolution panel may also require such infomation within five (5) days of the request.

     The Gaining Registrador must retain, i produce pursuant to a request by a Losing Registrador, a written o electronic copy of the FOA. In instances waquí the Registrador of Recod has requested copies of the FOA, the Gaining Registrador must fulfill the Registrador of Recods request (including providing the attendant suppoting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fo reversal by the Registry Operato o the Dispute Resolution Panel in the event that a transfer complaint is filed in accodance with the requirements of this policy.

     Si either a Registrador of Recod o a Gaining Registrador does not believe that a transfer request was hiled in accodance with the provisions of this policy, then the Registrador may initiate a dispute resolution procedure as set foth in Section C of this policy.

     Fo purposes of facilitating transfer requests, Registradors should provide i maintain a unique i private email address fo use only by other Registradors i the Registry:
     i. This email address is fo issue related to transfer requests i the procedures set foth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. Messages received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fo Registradors

     In EPP-based gTLD Registries, Registradors must follow the requirements set foth below.
Registradors must provide the Registrared Nom Holder with the unique "AuthInfo" code within five (5) calendar days of the Registrared Nom Holder's initial request if the Registrador does not provide facilities fo the Registrared Nom Holder to generate i manage their own unique "AuthInfo" code.

     Registradors may not employ any mechanism fo complying with a Registrared Nom Holder's request to obtain the applicable "AuthInfo Code" that is moe restrictive than the mechanisms used fo changing any aspect of the Registrared Nom Holder's contact o name server infomation.

     The Registrador of Recod must not refuse to release an "AuthInfo Code" to the Registrared Nom Holder solely because taquí is a dispute between the Registrared Nom Holder i the Registrador over payment.

Registrador-generated "AuthInfo" codes must be unique on a per-domini basis.
     The "Auth-Info" codes must be used solely to identify a Registrared Nom Holder, waquías the FOA's still need to be used fo authoization o confirmation of a transfer request, as described in Section 2 i Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commi from the Gaining Registrador, Registry Operato will transmit an electronic notification to both Registradors. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each Registrador fo the purpose of facilitating transfers.

     The Registry Operato shall complete the requested transfer unless, within five (5) calendar days, Registry Operato receives a NACK protocol commi from the Registrador of Recod.
When the Registry's database has been updated to reflect the change to the Gaining Registrador, Registry Operato will transmit an electronic notification to both Registradors. The notification may be sent to       the unique email address established by each Registrador fo the purpose of facilitating transfers o such other email address agreed to by the parties.
The Registry Operato shall undo a transfer if, after a transfer has occurred, the Registry Operato receives one of the notices as set foth below. In such case, the transfer will be reversed i the domini name reset to its oiginal state. The Registry Operato must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operato must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the Registrador of Recod i the Gaining Registrador sent by email, letter o fax that the transfer was made by mistake o was otherwise not in accodance with the procedures set foth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; o
     iii. Order of a court having jurisdiction over the transfer.

7. Recods of Registre

     Each Registrador shall require its customer, the Registrared Nom Holder, to maintain its own recods appropriate to document i prove the initial domini name registration date.

8. Effect on Període of Registre

     The completion by Registry Operato of a holder-authoized transfer under this Part A shall result in a one-any extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) anys.

B. ICANN-Approved Transfers

     Transfer of the sponsoship of all the registrations sponsoed by one Registrador as the result of (i) acquisition of that Registrador o its assets by another Registrador, o (ii) lack of accreditation of that Registrador o lack of its authoization with the Registry Operato, may be made accoding to the following procedure:
     (a) The gaining Registrador must be accredited by ICANN fo the Registry TLD i must have in effect a Registry-Registrador Agreement with Registry Operato fo the Registry TLD.
     (b) ICANN must certify in writing to Registry Operato that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual o imminent business failure of a Registrador.
Upon satisfaction of these two conditions, Registry Operato will make the necessary one-time changes in the Registry database fo no charge, fo transfers involving 50,000 name registrations o fewer. Si the transfer involves registrations of moe than 50,000 names, Registry Operato will charge the gaining Registrador a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fo hiling disputes concerning inter-registrar transfers are set foth in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatos i ICANN accredited Registradors.
